This means that the terminating party must express the unequivocal intention to terminate the contractual relationship and send the declaration to you. It can be issued by your employer or by yourself...\" class=\"encyclopedia\">Termination<\/a>The law only provides for claims to severance pay in the case of Section 1 a KSchG (see Rn 2 ff), in the case of a dissolution judgment according to Sections 9, 10 KSchG (see Rn 10 f), in the case of a social plan (see Rn 22 f) or as <a href=\"https:\/\/kanzleikruse.com\/en\/encyclopedia\/nachteilsausgleich\/\" target=\"_self\" title=\"If your employer implements a change in operations and deviates from a reconciliation of interests agreed with your works council without a compelling reason, or if it does not reach agreement with the works council at all beforehand, you may be entitled to compensation for disadvantages. This claim includes entitlements to severance pay and compensation for other disadvantages...\" class=\"encyclopedia\">Compensation for disadvantages<\/a>entitlement to severance pay according to Section 113 of the Works Constitution Act (see Rn 24 f). In addition, severance pay claims may arise from other legal bases, in particular from collective agreements (e.g. collective social plan, rationalization protection collective agreement), company or service agreements or the employment contract itself. Even if your employer usually pays severance pay in the event of <a href=\"https:\/\/kanzleikruse.com\/en\/encyclopedia\/kuendigung\/\" target=\"_self\" title=\"A termination is a unilateral declaration of intent that must be received. This means that the terminating party must express the unequivocal intention to terminate the contractual relationship and send the declaration to you. It can be issued by your employer or by yourself...\" class=\"encyclopedia\">Termination<\/a>en, a claim may arise from customary law or company practice. Only in exceptional cases do claims arise from general labor law institutions, such as company practice or the principle of equal treatment. Recently, <a href=\"https:\/\/kanzleikruse.com\/en\/encyclopedia\/diskriminierung-2\/\" target=\"_self\" title=\"Discrimination in the workplace is not uncommon. It also happens that employers dismiss on the basis of certain characteristics and this constitutes discrimination. To prevent this, the General Equal Treatment Act came into force in 2006. If the severance payment is paid out in full in one calendar year, a tax reduction, the so-called <a href=\"https:\/\/kanzleikruse.com\/en\/encyclopedia\/fuenftelregelung\/\" target=\"_self\" title=\"The one-fifth rule is a tax reduction that can be applied for severance payments.
