Your employer is obliged to protect your health and your personality in equal measure and to take active action against bullying. Bullying can lead to claims for damages and compensation for pain and suffering. However, if you wish to assert such claims, you may have to make use of contractual or collective bargaining agreements. <a href=\"https:\/\/kanzleikruse.com\/en\/encyclopedia\/ausschlussfristen\/\" target=\"_self\" title=\"Many employment contracts contain so-called exclusion or expiry periods. After expiry of the period specified therein, claims arising from the employment relationship expire if they are not asserted within the specified period. These are often two-stage preclusion periods. In the first stage, you or your employer must assert your claims against the...\" class=\"encyclopedia\">Limitation periods<\/a> and should therefore not take too long to file such a complaint.<\/p>\n<p class=\"p1\">Proof of bullying often proves to be problematic in such proceedings. A single incident is probably not sufficient for this. Rather, there must be repeated (systematic) defamatory statements or actions. In addition, the intensity of the actions must exceed normal conflict situations in working life. As the employee or person affected, you must demonstrate and prove the bullying. This includes being able to name the date, the persons involved and, ideally, witnesses for specific incidents.<\/p>\n<p class=\"p1\">If your employer has an appropriate contact point, such as a <a href=\"https:\/\/kanzleikruse.com\/en\/encyclopedia\/betriebsrat\/\" target=\"_self\" title=\"In principle, every company with at least five employees entitled to vote has the option of setting up a works council. The works council generally represents the interests of the workforce vis-\u00e0-vis the employer. The interests of the workforce are often set out in company agreements.
