fixed-term employment contract

The main regulations on fixed-term employment contracts can be found in the Part-Time and Fixed-Term Employment Act (TzBfG). There are also special statutory provisions for doctors, scientists, trainees or in the context of Parental leaverepresentations. In the case of an effective fixed term, the employment relationship ends either at the end of the agreed period or when a previously defined purpose has been achieved. A fixed-term employment relationship can only be terminated with notice if this has been contractually agreed or is provided for in a relevant collective agreement. A extraordinary termination on the other hand, is always possible. However, the fixed term must be agreed in writing and before the employee actually starts work. If this is done incorrectly or not at all, the fixed term is invalid and the employment relationship is permanent. If you are of the opinion that the fixed term is invalid, you can file an action for review of the fixed term within three weeks of the contractually stipulated end of the employment relationship. If the labor court finds in your favor, you are entitled to CONTINUED EMPLOYMENT until the proceedings have been legally concluded.
