Special payments
Special payments are benefits paid by the employer not with the usual salary, but on certain occasions or dates (e.g. Christmas). A distinction is made between special payments of a purely remunerative nature, those made to reward loyalty to the company and those of a mixed nature. If the employment relationship is terminated, for example due to Terminationthe employer can only reclaim payments made under certain conditions. As a rule, the outcome will depend on whether the employer can invoke a lawful retention clause.
